1. Acceptance of Terms

By using any FindLoka service, including our consumer platform, LokaPro professional platform, or API services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with all applicable laws and regulations.

2. Description of Services

FindLoka provides location intelligence services through multiple platforms:

  • Consumer Platform: AI-powered location scoring, analytics, and insights for individual users
  • LokaPro Professional Platform: Advanced real estate professional tools including client management, property comparisons, and smart matching
  • API Services: Programmatic access to our location data and analytics for businesses and developers

We analyze 300+ location metrics to provide insights, scores, and recommendations. We reserve the right to modify, update, or discontinue any aspect of our services at any time with reasonable notice.

3. User Accounts and Registration

  • You must provide accurate and up-to-date information when creating an account
  • You are solely responsible for maintaining the confidentiality and security of your account credentials
  • You may not share your login credentials, API keys, or allow unauthorized access to your account
  • Professional accounts may have additional verification requirements
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Service-Specific Terms

4.1 Consumer Platform

  • Free tier users may have limitations on search volume and feature access
  • Personalization features require creation of user profiles and preference settings

4.2 LokaPro Professional Platform

  • Professional accounts are intended for real estate professionals and related business use
  • Client data entered into the system must comply with applicable privacy laws
  • Users are responsible for obtaining necessary consents from their clients
  • Team accounts may have administrative controls and user management features

4.3 API Services

  • API access requires valid authentication keys
  • Rate limits apply: 60 requests per minute, 1,000 requests per day unless otherwise specified
  • Commercial use of API data may require separate licensing agreements
  • Bulk data extraction or scraping outside of normal API usage is prohibited

5. User Conduct and Restrictions

You agree not to:

  • Provide false, misleading, or fraudulent information
  • Use our services for any unlawful, harmful, or prohibited activity
  • Interfere with or disrupt our systems, servers, or networks
  • Attempt to access restricted areas or circumvent security measures
  • Reverse engineer, decompile, or attempt to extract our proprietary algorithms
  • Use automated tools to access our services except through official APIs
  • Resell or redistribute our data without proper licensing
  • Violate any applicable laws or regulations in connection with your use of our services

6. Intellectual Property Rights

All content, software, algorithms, scoring methodologies, trademarks, and materials provided through FindLoka services are our exclusive property or that of our licensors. This includes but is not limited to:

  • The Loka Score algorithm and methodology
  • Location analytics and scoring systems
  • User interface designs and functionality
  • Proprietary data compilations and analyses

You may not reproduce, distribute, modify, create derivative works, or use our intellectual property without written permission. Limited use rights are granted solely for your authorized use of our services.

7. Data and Privacy

Our collection and use of your information is governed by our Privacy Policy. By using our services, you consent to such collection and use. You retain ownership of data you provide, but grant us necessary rights to process and analyze such data to provide our services.

8. Service Availability and Performance

  • We strive to maintain high service availability but do not guarantee uninterrupted access
  • Scheduled maintenance may temporarily affect service availability
  • We may implement service limits to ensure fair usage and system stability
  • Third-party service dependencies may occasionally impact our service performance

9. Disclaimers and Limitation of Liability

  • Information Purpose Only: All scores, insights, analytics, and recommendations are provided for informational purposes only and do not constitute professional advice
  • No Warranties: We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of our services for any particular purpose
  • Investment Decisions: Our services are not intended to replace professional real estate, financial, or investment advice
  • Data Accuracy: While we strive for accuracy, we cannot guarantee that all data and analytics are error-free or current
  • Limitation of Liability: FindLoka shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages
  • Maximum Liability: Our total liability to you shall not exceed the amount you paid for our services in the 12 months preceding the claim

10. Payment Terms

  • Subscription fees are billed in advance and are non-refundable except as required by law
  • API usage fees may apply based on your usage tier and volume
  • Price changes will be communicated with at least 30 days notice
  • Overdue accounts may result in service suspension

11. Termination

  • You may terminate your account at any time through your account settings
  • We may terminate or suspend your access for violation of these terms
  • Upon termination, your right to access our services ceases immediately
  • Certain provisions of these terms will survive termination

12. Changes to Terms
